The eIDAS Registered Electronic Letter

Europe has adopted the eIDAS regulation governing electronic registered mail services (Articles 43-44). Our service is based on qualified components – time-stamping and eIDAS signature – constituting proof that is admissible throughout the EU (Article 43.1).

The Qualified Electronic Time-Stamp affixed to each shipment benefits from its own legal presumption of date accuracy and data integrity (Article 41 eIDAS), protecting the content against any modification after dispatch. Combined with the acknowledgement of receipt signed by the recipient, it constitutes a file of evidence with high probative value.

eIDAS electronic registered mail guarantees

Guaranteed integrity – The contents of your shipment cannot be altered once the Qualified Electronic Time-Stamp has been affixed.

Electronic registered mail is the digital equivalent of registered mail with acknowledgement of receipt. It enables you to send documents to a recipient with legal proof of receipt, all in compliance with the European eIDAS regulation.

In concrete terms, your documents are protected by a qualified electronic timestamp, guaranteeing their authenticity and integrity. Your recipient receives an e-mail inviting him or her to sign an acknowledgement of receipt with an eIDAS electronic signature. Once signed, they can access the documents, and you have a legally valid proof of receipt.

The European eIDAS regulation provides a framework for electronic registered mail services, distinguishing between two levels: qualified services (Article 44) and non-qualified services (Article 43). Our service falls within this second framework, reinforced by qualified components that give it a high probative value.

Any electronic registered document is admissible as evidence before the courts of all EU member states (Article 43.1): it cannot be denied legal effect on the sole grounds that it is in electronic form.

The higher the signature level chosen for the acknowledgement of receipt (QES > AES > SES), the greater the probative value.

A conventional e-mail provides no guarantee of receipt, content or integrity. The recipient may claim never to have received it, and there is no proof that the content has not been altered.

Electronic registered mail offers three guarantees that an email cannot:

  • Proof of receipt: the recipient signs an acknowledgement of receipt with an eIDAS electronic signature
  • Certified integrity: Qualified Electronic Time-Stamping protects content against tampering
  • Legal value: the entire system complies with the eIDAS regulation and is admissible as evidence in European courts.

The eIDAS regulation distinguishes between two levels of electronic registered mail services.

The qualified electronic registered mail service (Article 44 eIDAS) is delivered by service providers specifically qualified for this purpose and registered on the European Trust List. It benefits from an automatic legal presumption of data integrity, both when sent and when received.

The service offered by e-Signature.eu is a non-qualified electronic registered mail, reinforced by qualified trust components: a Qualified Electronic Time-Stamp (Article 41 eIDAS) and an eIDAS electronic signature on the acknowledgement of receipt. In accordance with Article 43.1 of the eIDAS regulation, this type of service cannot be denied legal effect on the sole grounds that it does not meet the requirements of a qualified service. It therefore constitutes admissible evidence before the courts of all EU member states, with a high probative value thanks to its qualified components.

In practice, for the vast majority of professional and contractual uses, this distinction has no impact: the chain of evidence constituted by the qualified time-stamp and the signed acknowledgement of receipt offers very high probative robustness. Only certain acts for which a national legal text expressly requires the use of a qualified EREQ or registered mail would remain outside the scope of our service – which concerns a minority of specific situations (certain lease terminations subject to strict national rules, for example).

Shipping takes just a few minutes:

Step 1 – Prepare your shipment

  • Give your registered mail a title and add a note for the addressee if necessary.
  • Enter the recipient’s contact details (name, email)
  • Upload your documents in any format
  • Choose the authorized signature method(s) for the acknowledgement of receipt

Step 2 – Set up the necessary credits

  • The number of credits is automatically calculated according to the signature method chosen.

Step 3 – It’s sent!

  • Our platform merges and converts your documents, affixes a qualified electronic timestamp, then sends the invitation to the recipient.

Once your registered mail has been sent, the process is fully automatic:

  1. Your recipient receives an invitation email containing the title of your registered letter, your personalized note (if you’ve added one) and a secure link.
  2. By clicking on the link, he/she accesses the acknowledgement of receipt, which he/she must sign to prove that he/she accepts receipt of the registered letter.
  3. Once the acknowledgement of receipt has been signed, the recipient can access the registered document.
  4. You will receive a notification confirming receipt, and you can download the signed acknowledgement of receipt from your dashboard.

The recipient receives an email informing him/her that a registered mail has been sent to him/her. This email contains the title of the registered mail, the sender’s note (if applicable) and a secure link.

By clicking on the link, the recipient is invited to sign the acknowledgement of receipt. This document includes the digital imprint of the document sent, as well as time-stamping information. By signing it, the recipient expressly consents to receive the communication electronically and immediately accesses the registered document.

The recipient does not need to have an account on e-Signature.eu.

If the recipient does not sign the acknowledgement of receipt within 15 days, the procedure stops automatically. During this period, reminders can be sent (manually or automatically, depending on your configuration).

The recipient also has the option of refusing the electronic registered letter. This refusal is an explicit act, time-stamped and recorded in the Audit Trail of the procedure – just like a registered letter refused at the counter.

As long as the acknowledgement of receipt has not been signed – either by expiry of the deadline or by refusal – the registered document is not forwarded to the addressee. Access to the contents is conditional upon signature of the acknowledgement of receipt.

In all cases, the sender retains all proof of dispatch:

  • Qualified electronic timestamp of the original document
  • Proof of invitation sent to recipient
  • Where applicable, time-stamped proof of refusal
  • The complete Audit Trail tracing every step of the process

Registered mail cannot be cancelled once it has been sent, just like registered mail.

The Audit Trail is a time-stamped log that automatically traces every stage of your electronic registered letter, from its creation to its conclusion. It constitutes a complete, unalterable record of proof.

What the Audit Trail records:

  • Creating a registered user and uploading documents
  • Applying the Qualified Electronic Time-Stamp to the document
  • Sending the invitation to the recipient (date, time, email address)
  • Reminders sent to the recipient, if any
  • Signature of acknowledgement of receipt by recipient (date, time, signature method used)
  • Or, if applicable, explicit refusal by the recipient or expiry of the 15-dayperiod

Each event is precisely time-stamped, creating a complete and verifiable chronology of the procedure.

Why it matters:

In the event of a dispute, Audit Trail enables you to demonstrate not only that the registered letter was sent and that the document was protected by a Qualified Electronic Time-Stamp, but also that the recipient was duly invited to view it – and how many times. If the addressee refused the registered mail or let the deadline expire, the Audit Trail keeps a record of this.

Combined with the Qualified Electronic Time-Stamp and the signed acknowledgement of receipt, the Audit Trail reinforces the probative value of the entire system. It can be consulted and downloaded at any time from your dashboard.

No. Just like a registered letter dropped off at the post office, an electronic registered letter cannot be cancelled once it has been sent. The Qualified Electronic Time-Stamp is affixed at the time of dispatch, guaranteeing the integrity and traceability of the process.

The Qualified Timestamp is a certificate issued by a Qualified Trusted Service Provider (QTSP) that irrefutably attests to the exact date and time your document was created.

It is automatically affixed to your document by our platform when the registered letter is sent. In concrete terms, it guarantees that :

  • The document existed on the date indicated
  • Its content has not been modified since that date.
  • Proof of date is certified by a trusted European authority

Time-stamping information (date, time, issuing authority) is included in the acknowledgement of receipt.

The hash (or digital fingerprint) is a unique sequence of characters generated from the exact content of your document by a cryptographic algorithm. In a way, it’s your document’s “fingerprint”.

This fingerprint is included in the acknowledgement of receipt, proving that the document received by the recipient is exactly the same as the one you sent. The slightest modification to the document – even a single character – would produce a totally different fingerprint.

The document is also directly protected by the qualified electronic time-stamping: any attempt to modify the document would automatically remove this protective element, making falsification immediately detectable.

This is a double guarantee of integrity: the hash in the acknowledgement of receipt and the qualified electronic timestamp on the document itself.

🔷 ACKNOWLEDGEMENT OF RECEIPT

The acknowledgement of receipt is a document automatically generated by our platform when your registered letter is sent. It contains :

  • Qualified timestamp information (date, time, timestamp authority)
  • The hash (digital fingerprint) of the document sent
  • Sender and recipient details
  • Legal notice of consent to electronic communication

By signing this document, the recipient confirms receipt of the registered letter and expressly agrees to receive any legal communication by electronic means, including electronic registered letters.

Signing the acknowledgement of receipt serves two essential functions:

Proof of receipt – By signing, the recipient proves that he or she has read the registered letter. This is equivalent to the signature on the acknowledgement of receipt of a registered letter.

Consent to electronic communication – By signing, you expressly agree to receive legal communications by electronic means, as required by several European jurisdictions.

Access to the registered document is conditional on this signature: the recipient can only consult the contents after signing the acknowledgement of receipt.

The acknowledgement of receipt will contain the following statement:

“The entire document, the digital signature of which is shown below, has been duly sent and received by the recipient, who expressly consents to receiving all legal communications by electronic means, including by registered electronic mail. A Qualified Electronic Time Stamp has been affixed, certifying the authenticity of the document, the integrity of its content and its protection against any subsequent modification, alteration or falsification.”

This statement establishes three important legal elements: confirmation that the document has been fully transmitted and received, the recipient’s explicit consent to electronic communication, and reference to the Qualified Electronic Time-Stamp, which protects the authenticity and integrity of the document.

The OTP method is suitable for the vast majority of cases. It confirms that the person with the email address/phone number has signed the acknowledgement of receipt, which is sufficient for most registered communications.

The advanced (Veriff) or qualified (itsme®, Evrotrust) methods are justified when the nature of the registered mail requires formal and indisputable identification of the addressee, for example in the context of a formal notice, a contract termination with high legal stakes, or an official notification where the identity of the addressee could be contested.
