eIDAS: the three signature levels and their weight
The European eIDAS Regulation (No 910/2014), directly applicable in Belgian law, distinguishes three levels of electronic signature. This hierarchy determines the evidential value of the document — and therefore the legal risk if it is challenged. QES is the only level legally equivalent to a handwritten signature. For any agreement liable to be contested, or whenever the document carries significant contractual value, QES is the benchmark. AES and SES do carry evidential weight — they can serve as proof — but they do not benefit from the automatic presumption of validity attached to QES.

The process in three steps
🛡️ Twofold evidential protection
The mechanism rests on two complementary elements: the Qualified Electronic Time Stamp establishes when the document existed and what its exact content was; the signed acknowledgement of receipt establishes who received it. Together they form a body of evidence considerably more complete than a plain email or a postal delivery notice.
What to know before sending
Three features of the service should be understood before building electronic registered mail into a procedural strategy:
- A 15-day window — the recipient has fifteen days to sign the acknowledgement of receipt. Automatic reminders can be sent during that period.
- Refusal is possible and recorded — the recipient may refuse the item. That refusal is time-stamped in the Audit Trail and is itself a piece of evidence.
- Until the acknowledgement is signed, the document is not transmitted — the sender nevertheless retains the Qualified Electronic Time Stamp, proof of the invitation, proof of any refusal and the complete Audit Trail.
- Sending is irrevocable — an electronic registered item cannot be cancelled once dispatched.
⚠️ Legal scope: let us be precise
e-Signature.eu’s electronic registered mail incorporates qualified components — the Qualified Electronic Time Stamp benefits from the presumption under Art. 41 eIDAS — but the service is not a fully qualified electronic registered delivery service within the meaning of Art. 44. The full presumption under Art. 43.2 therefore does not apply to it. Items remain admissible as evidence in all Member States under Art. 43.1. Where a procedure expressly requires a qualified registered delivery, check the applicable requirement.

Cross-border matters: INPI and intellectual property
