The mere fact that a user uses this website implies that they fully and irrevocably accept the following terms and conditions. The company VisitOnWeb reserves the right to modify these terms at any time with a minimum notice of thirty (30) days before the modifications come into effect. Continued use of the service after the new terms come into effect constitutes acceptance thereof. The purpose of these Terms is to define the terms and conditions governing the relationship between Users and VisitOnWeb. These Terms constitute a contractual agreement for an indefinite period from the User’s acceptance of this Agreement. The User undertakes, on each visit to the Site, to comply with all of these Terms without reservation. The User therefore acknowledges having read the Terms and accepts being bound by these provisions.
Eligibility for the Service
The User must have full legal capacity. In the event that the User is a minor, they must have obtained prior authorisation from their legal representatives in accordance with applicable laws and regulations. If the User accesses the Site on behalf of a company or any other legal entity, they are nonetheless personally bound by this Agreement.
Terms of Use of e-Signature.eu
It is prohibited to visit the e-Signature.eu website in an automated manner using a robot, crawler, indexing software or any other automated method. It is prohibited to request content from e-Signature.eu automatically or otherwise at a frequency substantially higher than that of a typical normal user. Please contact us in advance if you doubt whether your visit frequency is substantially higher than the typical normal visit frequency.
Financial Terms
All prices are exclusive of VAT. The user expressly accepts that once their order has been placed and paid for, they waive any right of withdrawal and any right to full or partial refund of their order. Rates are determined regardless of the signing methods used.
Validity and Expiry of Credits
Purchased credits are valid for a period of twelve (12) months from their date of purchase. After this period, unused credits are permanently lost, with no right to reimbursement or compensation. The User is solely responsible for monitoring the expiry date of their credits.
Credits and Technical Migration
In the event of migration to a new technical infrastructure, VisitOnWeb undertakes to guarantee the validity of credits purchased prior to the migration until their original expiry date. Credits that have not expired at the time of migration will remain usable according to the pricing in force at the time of use. The User will be informed by email of any pricing change affecting the use of their existing credits, with at least thirty (30) days’ prior notice.
Interruption of Service by VisitOnWeb
In the event of a definitive interruption of the service at VisitOnWeb’s initiative, unexpired and unused credits will be reimbursed on a pro rata basis, calculated on the basis of the unit price paid by the User.
Account Creation
A member account on the Site is created automatically upon the first order. This requires completing the registration form available on the Site by providing accurate, up-to-date and complete information. This information must subsequently be regularly updated by the User in order to maintain its accuracy. The User must choose a username consisting of a valid email address and a password, and must mandatorily provide the following information: their first and last name and an email address. Account access credentials are strictly confidential. In the event of unauthorised use of their account or any breach of the confidentiality and security of their identification means, the User must inform VisitOnWeb without delay.

Legal Basis for Processing
Personal data are processed on the following legal bases, in accordance with Regulation (EU) 2016/679 (GDPR) :
- Performance of the contract : processing necessary for the provision of the electronic signature service, management of the User account and billing ;
- Legal obligation : retention of certain data required by applicable regulations (in particular tax and accounting regulations) ;
- Legitimate interest : improvement of the service, fraud prevention and information security.
Categories of Data Collected
VisitOnWeb collects and processes the following categories of data :
- Identification data : surname, first name, email address ;
- Billing data : billing details, credit purchase history ;
- Browsing data : IP address, connection logs, cookie data ;
- Documents submitted for signature : VisitOnWeb, acting as a technical intermediary, does not access the content of transmitted documents, which are processed in encrypted form.
Retention Periods
Data is retained for the following periods :
- Account data : for the entire duration of the contractual relationship, then 3 years after the last activity for evidential purposes ;
- Billing data : 10 years in accordance with statutory accounting obligations ;
- Connection logs : 12 months ;
- Signed documents and associated certificates : 1 year after the date of signature, unless previously downloaded by the User.
Transfer of Personal Data
All technical service providers engaged by VisitOnWeb in connection with the provision of the electronic signature service (in particular for identity verification methods) are established within the European Union or the European Economic Area. No transfer of personal data to third countries takes place in connection with the use of the service.
User Rights
In accordance with the GDPR, the User has the following rights :
- Right of access to their personal data ;
- Right to rectification of inaccurate data ;
- Right to erasure (the “right to be forgotten”) under the conditions provided for by the GDPR ;
- Right to restriction of processing ;
- Right to portability of data provided on the basis of the contract or consent ;
- Right to object to processing based on legitimate interest.
These rights may be exercised by contacting VisitOnWeb at contact#AT#e-signature.eu or by post at the postal address indicated above. VisitOnWeb undertakes to respond within a period of one (1) month from receipt of the request. This period may be extended by two additional months in the event of a complex request, of which the User will be informed within the initial period.
Right to Lodge a Complaint
If the User considers that the processing of their data constitutes a breach of the GDPR, they have the right to lodge a complaint with the Belgian Data Protection Authority (DPA) : Rue de la Presse 35, 1000 Brussels – www.dataprotectionauthority.be.
Respective Roles in Data Protection
In the context of the electronic signature service, the following roles apply :
- The initiating User (the person who submits documents for signature) acts as data controller in respect of the personal data of the signatories they designate. It is their responsibility to ensure that the collection and processing of signatories’ data complies with the GDPR, in particular by informing them of the use of an electronic signature service and obtaining the necessary consents where applicable.
- VisitOnWeb acts as a processor within the meaning of Article 28 of the GDPR, processing signatories’ data on behalf of the initiating User, solely for the purpose of performing the electronic signature service.
- The qualified trust service providers (itsme®, Evrotrust, Veriff depending on the method chosen) act as independent data controllers for the authentication and identity verification operations incumbent upon them. Their own privacy policies apply to these operations.
The initiating User acknowledges being solely responsible for compliance with their GDPR obligations towards the signatories they designate, and indemnifies VisitOnWeb against any claim in this regard.
Publication Restrictions
To submit documents for signature, the initiator must complete the form provided for this purpose and undertakes to provide accurate and up-to-date information regarding, in particular, the description of their documents and the language chosen for submission. This information must not be likely to breach public order or public morality, provoke protests from third parties, or contravene applicable legal provisions. Information provided by the User is their sole responsibility; it is therefore their responsibility to verify its accuracy and to immediately report any error.
By exception, documents sent for signature are only accessible to the persons designated by the User.
VisitOnWeb reserves the unilateral right to refuse or deactivate before its term, without compensation, a User account and/or a submission for signature in the following cases :
- A title contrary to these terms and conditions of use.
- Any information that appears to it to be inappropriate or contrary to the spirit of the Site.
Users are prohibited from :
- transmitting, publishing, distributing, recording or destroying any material, in particular content in violation of applicable laws or regulations concerning the collection, processing or transfer of personal information ;
- creating fictitious profiles ;
- disseminating data, information or content of a defamatory, abusive, obscene, offensive, violent or violence-inciting nature, or of a political, racist or xenophobic nature, and in general any content that would be contrary to applicable laws and regulations or public morality ;
- using information, content or any data present on the Site in order to offer a third-party service ;
- practising reverse engineering, decompiling, disassembling, deciphering or otherwise attempting to obtain source code in connection with any underlying intellectual property used to provide all or part of the Services ;
- using manual or automated software or devices, coding robots or other means to access, explore, extract or index any page of the Site ;
- endangering or attempting to endanger the security of an e-Signature.eu website, including attempts to monitor, scan or test the vulnerability of a system or network, or to violate security or authentication measures without prior express authorisation ;
- counterfeiting or using the products, logos, trademarks or any other element protected by VisitOnWeb’s intellectual property rights ;
- simulating the appearance or functioning of the Site, for example by means of a mirror effect ;
- directly or indirectly disrupting or interfering with the Site or the Services, or imposing a disproportionate burden on the Site’s infrastructure, or attempting to transmit or activate computer viruses via or on the Site.
It is recalled that violations of system or network security may lead to civil and criminal proceedings. Users undertake to use the Site in good faith, in accordance with its professional purpose and with applicable legal and regulatory provisions, these Terms and prevailing practices.
Terms of Signatures Made via the Site
VisitOnWeb acts solely as a technical intermediary in the execution of electronic signatures, which are entrusted to its partner eID Easy. Users are therefore required to organise between themselves the legal and financial terms of their relationships, for which they will be solely responsible. They must ensure compliance with applicable legal and regulatory conditions and take responsibility for all disputes between the various Users. Furthermore, VisitOnWeb cannot be held responsible for the consequences of using the Site. VisitOnWeb in no way guarantees the accuracy of the information contained in the documents provided by the various Users. VisitOnWeb remains a third party to these contractual relationships and the User shall not in these circumstances take any action on any grounds whatsoever.
Access to Documents After Signing
Signed documents and the associated signature certificates are accessible for a period of thirty (30) days from the date of signature. After this period, documents are automatically and permanently deleted from VisitOnWeb’s servers, with no possibility of recovery.
The User may also manually delete any signed document at any time from their dashboard, before the expiry of the thirty-day period.
The User is invited to download and archive their signed documents as soon as possible following signature. VisitOnWeb cannot be held responsible for the loss of documents not downloaded within the allotted time. It is the User’s responsibility to archive their documents in accordance with the legal requirements applicable to their activity.
Access to and Use of the API
e-Signature.eu offers a programming interface (API) enabling developers and companies to integrate the electronic signature service into their own applications. Use of the API is subject to these General Terms and Conditions as well as the following specific conditions.
API Access
Access to the API is conditional upon the creation of a User account and the holding of valid credits. API access keys (credentials) are strictly personal and confidential. The User is fully responsible for their security and for any use made with their credentials, whether or not they are the author thereof.
Fair Use and Limitations
The User undertakes to use the API in accordance with its purpose, namely the integration of the electronic signature service into legitimate applications. The following are in particular prohibited :
- any automated use for testing purposes in excessive volumes outside the dedicated test environment ;
- any attempt to circumvent the credit counting mechanisms ;
- any resale or making available of API access to unauthorised third parties.
Test Environment
A separate test environment is made available, enabling real electronic signatures to be made at a reduced rate. This environment is exclusively reserved for development and integration testing. Any production use in the test environment is prohibited.
Integrator Liability
The User who integrates the API into a third-party application is solely responsible for compliance with the legal and regulatory obligations applicable to that application, in particular with regard to data protection, information of end users and eIDAS compliance. VisitOnWeb cannot be held responsible for the non-compliance of the User’s third-party application.
API Evolution
VisitOnWeb reserves the right to develop the functionalities and specifications of the API. Major changes will be communicated to API Users with reasonable prior notice to enable them to adapt their integrations.
Limitation of Liability
VisitOnWeb cannot be held responsible for the consequences of the use of data and information transmitted via the Site. The User remains entirely and solely responsible for the use of said data and information. VisitOnWeb is likewise not responsible for any direct or indirect damages or any damage whatsoever caused by an inaccuracy, lack of completeness, omission, negligence, etc. as mentioned above.
Use of Site Content
All content on the Site, including designs, texts, graphics, images, videos, information, logos, button icons, software, audio files and other elements, belongs to VisitOnWeb, which is the sole holder of all intellectual property rights thereto. Any partial or total representation and/or reproduction and/or exploitation of the content and Services offered, by any means whatsoever, without the prior written authorisation of VisitOnWeb is strictly prohibited and may give rise to legal proceedings.
Damages
VisitOnWeb is in no way liable for temporary or permanent damage or defects to the user’s data or computer equipment resulting from use of the websites. VisitOnWeb is likewise not liable for the possible transmission of viruses through the websites.
Website Availability
VisitOnWeb makes every effort to ensure good availability of its services but cannot guarantee that its services will be available at all times or that no failures or interruptions will occur. VisitOnWeb reserves the right to interrupt access to its services at any time and without prior warning for technical or other reasons, or to terminate the services. VisitOnWeb cannot be held responsible for failures or interruptions, nor for errors in electronic provision, and these cannot give rise to refunds, discounts or any other compensation, except in the event of wilful misconduct by VisitOnWeb.
Force Majeure
VisitOnWeb cannot be held responsible for the total or partial non-performance of its obligations under these Terms if such non-performance results from a force majeure event within the meaning of Article 1148 of the Civil Code, including : natural disaster, fire, flooding, lightning, prolonged power outage, failure of a telecommunications network, large-scale cyberattack, terrorist acts, governmental or regulatory decision, or failure of a third-party service provider upon which VisitOnWeb depends for the provision of the service (in particular qualified trust service providers). VisitOnWeb undertakes to inform the User as soon as possible of the occurrence of such an event and to implement all reasonable means to limit its effects.
Offers
Offers are always limited in number and in time. These conditions are communicated at the time of the offer. All requests are subject to approval by the sales department. The pricing proposed for each offer is always valid for the registration period, regardless of any increases during the current subscription period. Any possible price increase is mentioned in advance in the medium and/or communicated in writing, and is then applied automatically.
Evidence Agreement
Computer systems and files shall be deemed valid evidence in the relationship between e-Signature.eu and the User. VisitOnWeb may therefore validly produce, in the context of any proceedings and for evidential purposes, data, files, programs, records or other elements received, transmitted or stored by means of the computer systems operated by VisitOnWeb, on all digital or analogue media, and rely upon them, except in the case of manifest error.
Applicable Law
The applicable law is Belgian law. The invalidity, nullity or unenforceability of all or part of any of the above provisions shall not result in the invalidity and/or unenforceability of the other provisions. The Parties accept that electronic communication between them has the evidentiary force of written proof. Unless otherwise provided in the terms of a product or service, any dispute arising from the use of VisitOnWeb’s websites is subject to Belgian law and the courts of Brussels have exclusive jurisdiction.
