Documents requiring QES
Belgian and European legislation specifically requires the use of a Qualified Electronic Signature (QES ) for certain documents where maximum legal security is essential.
Documents subject to QES in Belgium
Why do these documents require an ESQ?
These documents share several characteristics:
- Significant financial stakes : Significant commitments
- Weak party protection: Consumers and employees
- Maximum legal certainty: Irrefutable proof in the event of a dispute
- Strict regulatory compliance: Supervision by public authorities
- Long-term archiving: Retention for 10, 30 or more years
- Undeniable evidential value: Non-repudiation guaranteed
⚠️ Penalties for non-compliance
The use of a simple electronic signature (instead of a QES) for the listed documents may result in: nullity of the contract, administrative sanctions, fines for the organization, non-recognition by the authorities.
Documents where QES is recommended
Although not required by law, the use of an ESQ is strongly recommended for :
- High-value commercial contracts (>€50,000)
- Sensitive confidentiality agreements (NDA)
- Strategic partnership agreements
- Sales of shares
- Commercial leases
- Representative mandates
- International documents requiring cross-border recognition
