Electronic Signatures and Registered Mail for Lawyers in Belgium

Formal notices, fee agreements, powers of attorney, terminations — sign and serve your legal documents online, with enforceable proof, no subscription and full eIDAS compliance.

A law firm’s daily routine rests on two constant actions: obtaining signatures on documents and formally serving notice on an opposing party. Both run into the same friction — postal delays, appointments just to sign, uncertainty about the date of receipt.

Both now have a digital equivalent governed by the European eIDAS Regulation: the electronic signature and electronic registered mail. This guide is written for lawyers practising in Belgium — sole practitioners, partnerships and incorporated firms alike — and explains how to use both in a legally sound way, with no subscription and no volume commitment.

🔑 What you will learn in this article

The three eIDAS signature levels and their legal weight, how electronic registered mail works and what its evidential value really is, concrete use cases in practice, and how both services draw on a single pool of credits without any subscription.

Two daily needs, two complementary answers

The Belgian bar — whether French-speaking (OBFG) or Dutch-speaking (OVB) — has not stood apart from the digital transformation of the legal professions. Clients expect the same fluidity from their lawyer as from their bank or public administration. The evidential rigour, however, remains intact: a document signed or served electronically must stand up in court.

✍️ Electronic signature

Obtaining a client’s or a party’s formal agreement to a document.

  • Fee agreement
  • Engagement letter
  • Power of attorney (mandat ad litem)
  • Non-disclosure agreement (NDA)
  • Settlement agreement
  • Mediation agreement
  • Minutes of a general meeting

📨 Electronic registered mail

Serving formal notice with enforceable proof of receipt.

  • Formal notice (mise en demeure)
  • Termination of a lease or contract
  • Formal payment reminder
  • Invoice dispute
  • Notice invoking a contractual clause
  • Convening a general meeting
  • Notification to a partner or tenant

⚠️ Important: authentic deeds excluded

Authentic deeds — executed before a notary — are governed by a separate regulatory framework. This article deals exclusively with private documents and notices served between parties.

eIDAS: the three signature levels and their weight

The European eIDAS Regulation (No 910/2014), directly applicable in Belgian law, distinguishes three levels of electronic signature. This hierarchy determines the evidential value of the document — and therefore the legal risk if it is challenged. It applies equally to signing a contract and to signing the acknowledgement of receipt for a registered item.

LevelLegal valueMethodsRecommended use
QES
Qualified

AES

SES
Simple

📌 The golden rule for lawyers

QES is the only level legally equivalent to a handwritten signature. For any agreement liable to be contested, or whenever the document carries significant contractual value, QES is the benchmark. AES and SES do carry evidential weight — they can serve as proof — but they do not benefit from the automatic presumption of validity attached to QES.

QES with itsme®: a Belgian advantage

In Belgium, the vast majority of private and professional clients already have the itsme® app — for banking, tax and administrative procedures. The app issues QES-level signatures across 32 European countries.

In practice, your client receives an email with a link to the document, opens it on their smartphone, confirms through itsme®, and the signature is applied within seconds. No additional installation, no specific hardware. For recipients based outside Belgium or in countries not covered by itsme®, Evrotrust extends QES coverage to 64 countries.

The four available methods — for both services

e-Signature.eu offers four methods, usable interchangeably to have a document signed or to have the acknowledgement of receipt of a registered item signed. The model is entirely prepaid: you buy credits only when you need them, and they never expire.

🔐
itsme® — Qualified Signature (QES) — 32 countriesThe benchmark method for Belgian clients and opposing parties. Strong identification through the app already used for online banking and tax filing. Legal equivalent of a handwritten signature. 1 credit per signatory.
🌍
Evrotrust — Qualified Signature (QES) — 64 countriesIdeal for cross-border matters and recipients based outside the Benelux. The same legal value as itsme®. 1 credit per signatory.
📸
Veriff — Advanced Signature (AES) — 198 countriesAI-based identity verification (video and identity document). No app for the recipient to install. High evidential value, worldwide coverage. 0.7 credit per signatory.
📧
Email OTP — Simple Signature (SES) — WorldwideA one-time code sent by email. Universal, with no prerequisites. Admissible as evidence under Art. 25.1 eIDAS. 0.4 credit per signatory.

✅ One pool of credits for both services

The same credits serve interchangeably for a signature or for a registered item, at identical rates. A firm therefore has no double subscription, no double invoicing and no second tool to master: a single dashboard brings signatures and registered mail together.

Electronic registered mail: the formal notice without the post office

Electronic registered mail lets you send one or more documents to a recipient with proof of receipt in the form of a signed acknowledgement. It is the digital equivalent of registered post with acknowledgement of receipt, within the European eIDAS framework.

For a firm the benefit is immediate: a formal notice goes out within minutes from the office — no printing, no trip, no delivery delay — and with traceability well beyond what paper offers.

The process in three steps

1
Merging and conversionYour documents (the notice, annexes, a statement of account) are merged and converted into a single secure PDF/A. All formats are accepted.
2
Qualified Electronic Time StampA Qualified Electronic Time Stamp issued by a qualified trust service provider (QTSP) is applied to the document. It establishes the certain date and, through the SHA-256 hash it embeds, the integrity of the content.
3
Signed acknowledgement of receiptThe recipient receives an invitation and must sign the acknowledgement of receipt before gaining access to the document. You choose the signature level required: OTP, Veriff, itsme® or Evrotrust.

🛡️ Twofold evidential protection

The mechanism rests on two complementary elements: the Qualified Electronic Time Stamp establishes when the document existed and what its exact content was; the signed acknowledgement of receipt establishes who received it. Together they form a body of evidence considerably more complete than a plain email or a postal delivery notice.

What to know before sending

Three features of the service should be understood before building electronic registered mail into a procedural strategy:

  • A 15-day window — the recipient has fifteen days to sign the acknowledgement of receipt. Automatic reminders can be sent during that period.
  • Refusal is possible and recorded — the recipient may refuse the item. That refusal is time-stamped in the Audit Trail and is itself a piece of evidence.
  • Until the acknowledgement is signed, the document is not transmitted — the sender nevertheless retains the Qualified Electronic Time Stamp, proof of the invitation, proof of any refusal and the complete Audit Trail.
  • Sending is irrevocable — an electronic registered item cannot be cancelled once dispatched.

⚠️ Legal scope: let us be precise

e-Signature.eu’s electronic registered mail incorporates qualified components — the Qualified Electronic Time Stamp benefits from the presumption under Art. 41 eIDAS — but the service is not a fully qualified electronic registered delivery service within the meaning of Art. 44. The full presumption under Art. 43.2 therefore does not apply to it. Items remain admissible as evidence in all Member States under Art. 43.1. Where a procedure expressly requires a qualified registered delivery, check the applicable requirement.

Electronic or postal registered mail?

The comparison is striking on the criteria that matter to a firm: speed, cost and the quality of the record.

💡 A concrete example — a three-partner firm

A formal notice sent to a debtor, acknowledgement of receipt signed by OTP: 0.4 credit.
A fee agreement signed by a new client through itsme® (QES): 1 credit.
An NDA signed by a client based abroad through Veriff (AES): 0.7 credit.

All three operations — two signatures and one registered item — draw on the same shared pool of credits, with no monthly subscription and no minimum usage. Volume discounts apply automatically on larger credit packs.

The Audit Trail: essential traceability in a legal context

Whether a signature or a registered item is involved, every firm must be able to establish not only that a document was signed or received, but also when, by whom and under what conditions. That is precisely the purpose of the Audit Trail, included automatically with every request.

This time-stamped log records each stage of the process:

  • Invitation sent to the signatory or recipient
  • Document viewed (date and time)
  • Signature applied
  • Signed document downloaded
  • Any change of email address (also recorded)
  • Any refusal or abandonment

The Audit Trail can be consulted in real time from the dashboard and downloaded as a time-stamped PDF once the request is finalised. It is included at no extra cost with every operation.

✅ Evidential value of the Audit Trail

In the event of a challenge, the Audit Trail is a complementary piece of evidence documenting the entire course of the process: the time stamp of each stage and the recipient’s interactions with the document. A refusal of a registered item also appears there — information that is often decisive when a court assesses the parties’ good faith.

Cross-border matters: INPI and intellectual property

For lawyers working in intellectual property with filings in France, a specific rule applies. The INPI (Institut National de la Propriété Industrielle) requires a QES-level signature exclusively for trademark and patent filings.

📋 The INPI rule — essential to remember

Only itsme® and Evrotrust are accepted for INPI formalities. Advanced signatures (Veriff) and simple signatures (email OTP) are not accepted for those filings. If you advise clients on French trademark or patent filings, make sure you use one of these two QES methods.

This requirement illustrates why it matters to have a solution that offers QES natively — without moving to a higher subscription tier or bringing in a third-party provider.

Setting up both services in your firm

Getting started requires neither specific training nor a contract. Here is how to begin in practice:

1
Buy prepaid creditsGo to e-signature.eu and buy a credit pack. Your account is created automatically on your first purchase. Credits never expire and serve both signatures and registered mail.
2
Choose the service and upload your documentsFrom the dashboard, choose “signature” or “registered mail”, then upload your files (PDF, Word, ODT, Excel, images and more). Multiple files are merged automatically into a single document.
3
Recipients and signature levelEnter the name and email of each signatory or recipient, and choose the level that matches the stakes: itsme® for an important formal notice, OTP for a routine payment reminder. A registered item has a single recipient; a signature request may have several, with a signing order if needed.
4
Send and trackEach recipient receives an email in the language of their choice (FR, NL, EN, DE, ES). Automatic reminders can be configured at intervals of 1 to 14 days. The status of every request is visible in real time.
5
Retrieve the evidence fileThe signed document, the acknowledgement of receipt and the Audit Trail in time-stamped PDF form are all available from your dashboard. Documents are kept there for 30 days and can be deleted at any time — remember to file them in your client record.

✅ GDPR compliance and professional secrecy

All data is hosted in Europe and the platform is GDPR compliant. No advertising tracking tools are active. Documents are kept for 30 days and can then be deleted manually from the dashboard — a parameter worth building into your retention policy.

Why a subscription-free model suits law firms

Most solutions on the market — DocuSign, Adobe Sign, Yousign — run on a monthly or annual subscription. That model suits organisations with high, predictable volumes. For a law firm, whose activity follows the rhythm of its cases, it often means paying for unused capacity, or exceeding quotas in busy months.

e-Signature.eu takes a different approach: no subscription, no fixed fees, no commitment. You buy credits when you need them and use them according to your actual activity — for signatures as much as for registered mail.
