As early as 2018, it put in place a national legal framework complementing the eIDAS Regulation to create legal equivalence between qualified electronic registered mail (LRE — lettre recommandée électronique) and postal registered mail with acknowledgement of receipt (LRAR).

This formal recognition opens the way to fully digitising registered correspondence — but the French framework has its own requirements and subtleties. Here is what you need to know.

The French legal framework

The European foundation: eIDAS

The eIDAS Regulation (910/2014) is directly applicable in France as in the other 26 EU Member States. Three articles structure the matter:

Article 43.1 — any electronic registered mail is admissible as evidence and cannot be refused solely because of its electronic form

Article 41 — a Qualified Electronic Timestamp carries a standalone presumption of accuracy of the date and integrity of the data

Article 43.2 — the full presumption is reserved for fully qualified services within the meaning of Article 44

Article L.100 of the CPCE

France supplemented the eIDAS framework with Article L.100 of the Postal and Electronic Communications Code (CPCE). Its wording is unambiguous:

“Electronic registered mail is equivalent to sending by registered letter, provided it meets the requirements of Article 44 of Regulation (EU) No 910/2014.”

⚖️ Practical consequence

Wherever French law requires “registered mail with acknowledgement of receipt”, a qualified LRE is legally equivalent. Lease termination, formal notice, notice to quit: the LRE carries the same weight as postal registered mail.

The equivalence is, however, conditional on full compliance with Article 44 eIDAS. A service that does not meet it is not “electronic registered mail” within the meaning of L.100.

The decree of 9 May 2018

Decree No. 2018-347 of 9 May 2018, applicable since 1 January 2019, sets out the detailed rules for the LRE in Articles R.53 to R.53-4 of the CPCE: conditions of sending, proof of deposit, the acknowledgement of receipt process and management of recipient consent.

ANSSI qualification

In France, providers wishing to offer the qualified LRE must obtain a qualification issued by ANSSI (the national cybersecurity agency). This qualification certifies that the provider meets the requirements of the eIDAS Regulation and of French law.

The list of qualified providers is published on the ANSSI website and on the French Trusted List, accessible via the European Commission.

⚠️ Article L.101: a sanction worth knowing about

The CPCE attaches a penalty to this framework. Under Article L.101, offering or providing a service that does not meet the requirements of Article L.100 — in particular by misleading the sender or the recipient as to the legal effects of the send — is punishable by a fine of €50,000.

In plain terms: a provider not qualified by ANSSI cannot let anyone believe its service is equivalent to an LRAR. That is precisely why transparency about the level of service matters — and why e-Signature.eu does not claim LRAR equivalence (see below).

Qualified LRE vs non-qualified send: the French distinction

Criterion

Non-qualified electronic registered mail

Qualified LRE

Legal basis

eIDAS Regulation (Articles 41 and 43.1)

eIDAS (Article 44) + Article L.100 CPCE

ANSSI qualification

❌ Not required

✅ Mandatory

LRAR equivalence

❌ Not recognised

✅ Full legal equivalence

Presumption linked to the timestamp

✅ Yes, with a Qualified Electronic Timestamp (Article 41)

✅ Yes

Full legal presumption

❌ No — judge’s assessment

✅ Integrity, identification and date (Article 43.2)

Consent of a private recipient

Outside the scope of L.100

Mandatory and prior

Admissibility in court

✅ Admissible as evidence

✅ Admissible with a presumption of reliability

💡 An important point

Non-qualified electronic registered mail cannot be denied legal effect solely because it is in electronic form (Article 43.1 eIDAS). It is admissible as evidence before French courts — but it enjoys neither LRAR equivalence nor the full presumption of Article 43.2.

For most B2B and contractual relations, a send that incorporates qualified components — a Qualified Electronic Timestamp, which carries its own legal presumption (Article 41 eIDAS) — together with a signed acknowledgement of receipt constitutes solid and often sufficient evidence.

Recipient consent

This is one of the most important French specificities. Article L.100 imposes consent rules that vary with the nature of the recipient.

Private recipient

Prior consent is mandatory. The recipient must have expressly indicated to the sender their agreement to receive electronic registered mail. In a dispute, it is for the sender to prove that consent was obtained — so a written record must be kept.

Professional recipient (B2B)

Consent is not required. Professionals are presumed to have consented to receiving electronic registered mail (Articles L.100-I and R.53-3 CPCE). The send can go directly to the recipient’s business email address.

💡 On e-Signature.eu

The process is straightforward: the recipient receives an email inviting them to sign the acknowledgement of receipt. By signing, they expressly consent to communication by electronic means — that clause appears in the acknowledgement itself. No pre-registration or account creation is required on the recipient’s side.

This consent is concomitant with receipt, not prior to it. It therefore does not replace the prior consent required by Article L.100 for a qualified LRE addressed to a private individual. For B2B exchanges, where prior consent is not required in any event, the question does not arise.

Use cases in France

🏠 Lease termination

For residential leases, French law requires an LRAR or an ANSSI-qualified LRE — one of the cases where full qualification is necessary, and where the private tenant’s prior consent is required. For commercial leases and B2B terminations, eIDAS electronic registered mail with a Qualified Electronic Timestamp is a solid alternative.

⚖️ Formal notice

A formal notice between professionals by electronic registered mail is valid under French law: prior consent is not required in B2B. The Qualified Electronic Timestamp certifies the sending date, and the signed acknowledgement of receipt proves receipt. For a formal notice to a private individual with LRAR effect, use an ANSSI-qualified provider.

📢 General meeting convocations

The articles of association of many French companies provide for convocation by registered mail. Each electronic registered item addresses a single recipient, like a postal item: you therefore create one send per shareholder. Each takes a few minutes from your dashboard, with an individual timestamped acknowledgement of receipt.

💼 Employment law

Certain employer/employee notifications can be made by electronic registered mail: employment contract amendments, notification of economic redundancy (subject to conditions). The framework is evolving and case law is gradually consolidating. If you want the full LRAR legal equivalence, an ANSSI-qualified provider is necessary. For commercial leases and B2B terminations, eIDAS electronic registered mail is generally sufficient.

Is eIDAS electronic registered mail accepted by French courts?

Yes. Article 43.1 of the eIDAS Regulation, directly applicable in France, provides that electronic registered mail cannot be denied legal effect solely because it is in electronic form. It is admissible as evidence. The full presumption of Article 43.2 is reserved for fully qualified services, but the Qualified Electronic Timestamp integrated by e-Signature.eu carries its own legal presumption of accuracy and integrity (Article 41 eIDAS), which considerably strengthens the evidential value of the send.

Do I need to obtain my recipient’s consent?

For professional recipients, no: they are presumed to have consented (Article L.100-I CPCE). For private individuals, Article L.100 requires prior written consent where you want the LRAR equivalence via a qualified LRE. That is one more reason to reserve e-Signature.eu for your B2B and contractual exchanges.

What is the difference with AR24, Docaposte or other French providers?

ANSSI-qualified providers offer the qualified LRE with full LRAR equivalence, generally on a subscription basis. e-Signature.eu offers eIDAS-compliant electronic registered mail, with no subscription and pay-as-you-go. The choice depends on your need: formal LRAR equivalence, or eIDAS proof of receipt for your contractual and commercial exchanges.

Key takeaways

France recognises the qualified LRE as equivalent to the LRAR: Thanks to Article L.100 CPCE and the 2018 decree (applicable since 1 January 2019), ANSSI-qualified electronic registered mail carries the same weight as postal registered mail with acknowledgement of receipt.

The eIDAS framework applies directly: All electronic registered mail, even without ANSSI qualification, is admissible as evidence in France (Article 43.1 eIDAS), and the Qualified Electronic Timestamp carries its own legal presumption (Article 41). For B2B and contractual relations, that is often sufficient.

Consent depends on the recipient: Prior and mandatory for private individuals, presumed between professionals (B2B).

Article L.101 sanctions misleading claims: Offering a service while letting people believe it is equivalent to an LRAR when it does not meet Article L.100 exposes you to a €50,000 fine. Transparency about the level of service is not optional.

The subscription-free model is an advantage for SMEs: French qualified providers work on subscriptions. e-Signature.eu offers a pay-as-you-go model for less than €2 excl.
